Murdered Melbourne underworld figure Nabil Magny likely exploited his desire to be part of a crime family to commission his son to shoot at Love Machine nightclub. the court said.

Jacob Elliott’s lawyers say Elliot was young and tried to impress his father when he followed Magny’s instructions to take revenge on Prahran nightclub by firing four shots from his car on April 14, 2019. said he was desperate.

Two people were killed and three injured in a shooting outside the club at 3am.

Elliott, who was 18 at the time, and his driver, Alan Fares, were convicted of murder and attempted murder by a Supreme Court jury in April of this year.

After Elliott’s half-brother, Ari Magny, was ejected for bad behavior, they drove to the club in a stolen Porsche to talk to their father and to Elliott after the incident.

Elliott and Fares faced the second day of pre-sentencing hearings on Thursday, and were also joined by Moussa Hamka, who was convicted of assisting charges.

Elliott’s barrister, Julie Condon QC, told the Supreme Court that “it is likely that Nabil Magny planned the retaliatory attack.”

“You are a criminal with a criminal record and your son has reached his breaking point…he is in desperate need of acceptance and has a false sense of loyalty to Mr. Magny.

“The role of Nabil Magny cannot be eliminated, excluded, or divorced under the circumstances in which this event occurred.”

Mr Condon said the jury’s verdict was the “ultimate architect” of the shooting, whether Elliott was directed by his father or Mr Magny was the “type of person” who could have ordered such an attack. It said it had not determined whether it was

There was no direct evidence of communication between Elliott and his father in the hours before the shooting, but Magny used an encrypted phone call to communicate with Elliott, she said.

She argued that Elliott deserved a reduced sentence because his father was likely involved in planning the attack.

Nabil Magny died in January 2020 after being shot in a car park north of Melbourne.

After being raised by a single mother, Elliott did not meet his father’s family until he was ten years old.

He moved in with his father at the age of 15 and soon became immersed in a fast-paced lifestyle of money, cars and expensive clothes.

“Honestly, I feel like he’s taken on his father’s persona,” she said.

His paternal aunt, Fay Magny, said Elliot came from a family of predominantly female relatives, and that her siblings may have been intimidating.

She said they didn’t speak to each other for a year when Mr. Magny punched Elliott.

“You put a 15-year-old boy with a man who had a lot of power and authority and a lot of respect and Jacob didn’t know how to deal with that,” she said. . .
